  1. Who is responsible for the processing of your data?

The party responsible for processing your data is “FERMAX ELECTRÓNICA, SAU”, with registered office in Valencia, 46017, Avenida Tres Cruces, number 133, (Spain), and NIF A-46.036.554 (hereinafter, “ FERMAX ”).

  1. What categories of personal data will FERMAX process?

When using the DuoxMe application from FERMAX (hereinafter, the “ Application ”), we will process different types of personal data of the client and/or user, which are included, as the case may be, within one of the categories set out below:

  • Identification data: IP address and user name.
  • Contact information: Email and postal address.
  • Identification data: Images.

  1. For what purpose and on what legal basis does FERMAX process your personal data?

At FERMAX we will process your data for the following purposes and, in each case, in accordance with the legal bases set out below:

 

a) Application Registration

FERMAX will process the personal data that you provide us through the registration form provided for this purpose in the Application to manage your registration, create your profile within the Application and enable your access to the FERMAX digital service (hereinafter, the “ Digital Service ”).

The processing of the data you send us through this form is necessary to give you access to the Application through which you will use the Digital Service. For this activity, we will process your contact information . The legitimate basis for such processing is the development of the contractual relationship, as well as your consent.

b) Provision of the Digital Service to the user

FERMAX will process your personal data as a registered user so that you can use the Digital Service and give you access to the different functionalities (depending on the home terminal and/or the User's service plan) through the Application (e.g., digital opening of community doors, forwarding of calls made to the video intercom, etc.).

In addition, you will receive notifications through the Application informing you of changes that may affect your profile (e.g., when you are invited to use the Digital Service in a home, informed of new versions of the Application available or any other relevant information regarding the use of the Digital Service), and you may change your access password, if you deem it appropriate, through the section provided for this purpose in the Application.

This processing is necessary for the proper execution of the contractual relationship. For this activity we will process your contact information .

Likewise, if you meet the requirements to use the “automatic image capture” or “ photocaller ” functionality, you will be able to consult, through the activity log in the Application, the calls you receive through the video intercom, including, among other data, a photograph of the person who called your home at that time, which could be a third party or yourself if you are the one who called your own home.

This photograph is taken through the camera on the street panel every time someone calls your home and is stored on the FERMAX servers for a maximum of one (1) month so that you can consult it through the Application. After this period, the captured images will be automatically deleted and cannot be consulted in accordance with the provisions of Organic Law 3/2018, of December 5, on the Protection of Personal Data. FERMAX only processes the stored images for their conservation during the legally established period.

For this activity we will process identifying data . The legitimate basis for such processing is the development of the contractual relationship, as well as your consent.

 

c) Registration of new members

Users who are registered in the Application with the role of “ main user ” or “ administrator ” (identified in the Application with the label “ Owner ”) in a certain property, will be of legal age, and may invite new members as “ guest users ” of said property to use the Application by entering the email address of such third parties.

Once entered, FERMAX will send invited users an email communication through which said third parties will be able to register as new members of the household to which the main user has invited them in order to be able to use the Digital Service.

This processing is carried out with the consent of the guest user. For this activity we will process the guest user's email address that has been provided by the main user. The legitimate basis for said processing is the development of the contractual relationship, as well as the consent of the main user.

When you provide us with personal data of third parties (guest users or new members), you must do so with their consent - and if they are minors, with the consent of their parents or guardians - and you must have informed them, in advance, of the aspects contained in this Privacy Policy so that they are aware of the use of their personal data by FERMAX.

d) Compliance with legal obligations

FERMAX may process your data to comply with the various legal obligations that may be required at any given time, including compliance with data protection rights.

Additionally, if requested by any Court or Tribunal, the State Security Forces or any other competent Authority or Public Administration, we may also have to provide your personal data, as we are legally obliged to do so.

For this activity we will process your contact and identification data . The legitimate basis for such processing is compliance with a legal obligation.

e) Cookies

Users are informed that the cookies (or similar storage technologies) used by FERMAX in the Application (hereinafter, the “ Cookies ”) are subject to the exception established in article 22.2 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, and therefore it is not necessary to obtain the user's consent for their use. Specifically, the purposes of the Cookies used in the Application are: (i) to allow communication between the Application and FERMAX servers; ( ii ) to provide the Digital Service expressly requested by the user; ( iii ) to authenticate or identify the user to start and maintain a session with the Digital Service; (v) to guarantee the user's security during the use of the Digital Service; (vi) to personalize the Application's interface; ( viii ) to anonymously analyze the use of the Application by users to improve the Digital Service.

 

f) Obtaining prizes linked to commercial promotions

FERMAX may use the personal data provided by users during the registration process in the Application so that they may be eligible for prizes in any promotions that may be in effect and in which the user has decided to participate. In each promotion, the user will be informed of their rights regarding the protection of personal data.

  1. How long will we retain your data?

The personal data to which FERMAX has access will be processed as long as the purpose for which they were provided is maintained. In any case, once they are no longer necessary, we will keep your personal data duly blocked. In accordance with the legal provisions, we will retain them only (i) for the periods determined in each case by the applicable regulations, and ( ii ) during the limitation period for actions that may arise from the relationship maintained with the interested party.

Once these periods have elapsed, we will proceed to permanently delete them.

  1. How do we obtain the data processed in the Application?

The data processed by FERMAX are obtained in the following ways:

  • Data obtained from the interested party : you provide them directly and voluntarily during registration in the Application, the use of the Digital Service or the development of the relationship you maintain with FERMAX.
  • Data obtained through the main user or administrator of the monitor : information from other users that the main user provides us, having previously informed them about the processing of personal data that FERMAX will carry out, as well as having obtained the necessary consent for said processing to become effective.

  1. To which recipients will your data be communicated?

FERMAX ELECTRÓNICA, SAU is the entity responsible for the processing of your personal data. However, unless prohibited by current legislation, other companies may have access to your personal data when they provide services to FERMAX as data processors to fulfill the purposes described in this Privacy Policy. Both the controller and the data processors will determine the appropriate technical and organizational measures to be applied in order to guarantee and certify that the processing is in accordance with the law, its implementing regulations and the applicable sector legislation. Additionally, on certain occasions, your personal data may be communicated to third parties to whom we are legally obliged to provide it, such as Public Agencies and Authorities , the Tax Agency, the Courts and Tribunals or the State Security Forces and Corps.

Likewise, in the event that users decide to participate in the current promotions detailed in the Terms and Conditions of use of the Application , FERMAX may share with the third parties responsible for delivering the prizes, which in each case apply, the personal data that are necessary so that said reward can be received by the user.

  1. Should you keep your data up to date?

In accordance with applicable regulations and in general, you must be the owner of the data that you provide to us for our databases, and said data must be correct, complete, accurate and duly updated.

However, if, as the main user or administrator of the monitor, you provide us with personal data of other users, we advise you that you must do so with their consent and that you must have informed said users, in advance, of the aspects contained in this Privacy Policy so that they are aware of the use of their personal data by FERMAX.

If any of the personal data you have provided to us changes, especially your postal address or email address, you must notify us as soon as possible so that we can update it in our databases.

Otherwise, if you do not inform us of these possible changes, any communications we have sent to the email address listed in our internal records will remain valid.

  1. What are your rights when you provide us with your data?

The user has the right to access, rectify, oppose, delete, limit the processing, portability of personal data and withdraw the consent given at any time, freely and accessible by sending a communication to the email address support.duoxme@fermax.com , from the same email address with which the registration in the Application was formalized.

Likewise, you may ask questions regarding your personal data by sending an email to privacidad@fermax.com from the same email address with which you registered in the Application.

Finally, you may file a claim at any time with the Spanish Data Protection Agency, through the website https://www.aepd.es , especially when you have not obtained a satisfactory response in the exercise of your rights by writing to privacidad@fermax.com .
